Death Knight picture in Gazette

Hey I just noticed that there is a picture of a Warcraft 2 Death Knight as the background image of the gazette.

Isn't this a copyright violation? Unless Metzen has given permission...

Actually, if you go to http://www.templatemonster.com and look under the games category for website templates, that's the template for the Gazette.
The only reason I know about the site is while I was trying to build my old guilds site, I went looking at other templates for ideas.
